People are asking ... what will the KCB City Commission do the Public Hearing and Regular Meeting on August 21?

Public Hearing

The city commission will host a public hearing and regular monthly meeting in Marble Hall and on Zoom on Thursday, August 21, beginning at 9:30 a.m. The public hearing will consider a variance request for a pool that would encroach on the setback by 5 feet on 11th Street.

Note that the restriction on public commentary continues for the public hearing and for the regular meeting; "Members of the Public may speak for three minutes and may only speak once unless waived by a majority vote of the commission."

Regular Commission Meeting

The city commission will host a regular monthly meeting in Marble Hall and on Zoom on Thursday, August 21, beginning at 9:35 a.m. or at the conclusion of the public hearing.


There are many big issues on the agenda this month. KCBers may want to ask our commissioners about many, many items in particular:
  • Since Commissioner Harding understands, "The person that does not rent is supplementing the people who do rent." about the rental program fees, why doesn't KCB apply the same question of fairness to the sewer fees or to stormwater assessments both of which are charged flat or "per dwelling unit" fees irrespective of usage or land area?
  • Will the commissioners explain why they want to change the Sunset Park ordinance to allow fishing from the pier?
  • The Special Meeting did not address the expected total project cost of five to six million dollars. Would the commissioners please examine that now?
  • Does the commission plan to have an architectural review by the Planning & Zoning committee?
  • Where will the physical and digital records be stored that they are safe and protected from water damage?
  • Will the commissioners explain why the dark blue roof won't cause significantly higher cooling costs?
  • What is the alternate plan if the final drawings attract construction bids well over the budget?
  • Will the commissioners explain why the administration and the building departments must be walled off against the public?
  • The three-story entry building still appears to violate city ordinances, the Florida Building Code, and a Florida statute. Will the commissioners please explain why it is okay to build this plan.
  • Will the commissioners please explain why there are seats for as many as three receptionists, seven police officers, and eleven other staff?
  • Will the commissioners please explain why we will spend nearly a million extra tax dollars for the empty lobbies, the "open atrium" and the gym folly.
  • People requiring ramp access to the "fitness room" will have to enter by the locked, ground floor admin office door, navigate up the ramp around the elevator to the lobby to get to the gym, all using an "access card." Will the commissioners please discuss who programs, issues, and maintains the cards? (Anyone who has used an access card in a hotel recently knows how often they fail but hotels have 24-hour desk service.)
The agenda includes:

Special requests include recognition of Chief DiGiovanni for 20 years of service.

Administrative Notes:
The chief requests approval for a 2021 Ford F150 Responder Truck for $24,000.
With hurricane season upon us, the administrator will explain an Early Alert system. He will introduce the lobbyist agreement with Ron Book for $50,000. He will discuss stewardship, FDEP alternative water supply, resilient Florida, nonpoint source federal and state, and flood mitigation assistance grants.
The building department is streamlining plan reviews, permit approvals, and inspections. Asbestos abatement is complete in Marble Hall and city hall. All directional boring work is complete on Sadowski.

The commission votes for Consent Action Items with a single motion. This month they include a spending warrant for $1,101,464.52 and a $34,875 agreement with OVID to administer grants.

The commission will review the US Water Contract and discuss entering an MOU with Marathon.

The commission will discuss and approve awarding sole bidder ITB $122,750 for the Detention Pond fountain system and an additional $175,411.41 for Detention System landscaping.

The commission will discuss and approve an Interlocal Agreement with Monroe County for fleet maintenance and repairs.

The commission will discuss and approve amending the contract with CPH to pay an additional $48,000 plus 5% of the design fees for any part of the final construction cost more than $2,731,480.

The commission will discuss and approve a resolution to extend the agreement with Marathon for emergency medical and fire services.

The commission will do the first readings of five new ordinances:
Amending the sewer monthly rates and charges,
Amending the powers and duties of committees, and the limitations on use of certain city park property to permit fishing from designated areas of the Sunset Park pier,
Modifying the responsibilities and meeting procedures of the Beautification Committee under the Development Review Committee,
Amending the actions of the planning and zoning committee for appeals from administrative hearings and variances,
Amending utility board membership and 14-49 meetings.

Commissioner Tom Harding will publish the July 2025 Financial Summary and FY25/26 budget updates. He will also give the Wastewater Sampling Summary Report of August 18th and an update on Dry Floodproofing.

Mayor Freddie Foster will discuss the TDC grants for pickleball sail shades (similar to the Sunset Park sail shades) and for improvements to the Sunset Park fishing pier. He also has information about the 7th Street parking lot.

The agenda has no information about the city attorney’s report or commissioner’s reports and comments from Commissioner Colonell or DiFransico.
