How Does the KCB Commission Violate the Law? Let Us Count the Ways

This page summarizes the letter we hand delivered to the Key Colony Beach city commission. [Read that letter and more here.] It has details of the statutes this process has violated. The commission and city officials have snubbed "government in the sunshine" while threatening city committees with Sunshine prosecutions. The commission and city officials have violated the Administrative Procedure Act.

KCB Citizens have the duty and the right to help the commission make educated--not arbitrary or capricious--decisions. It is our right to challenge those decisions and WE DO.

Today's agenda shows your intent to award contracts for plans and bids which the commission and city officials have forbidden citizens from possessing or disputing. You have put reversible error into this process
 • The selection of the architect and approval of the plans was flawed. The commission and city officials did not solicit bids. The design you approved violates our own LDR and ordinances. It is not in harmony with the area. And more.
 • The bid process was also badly flawed. The bid documents were incomplete, full of errors, and changed repeatedly throughout the bid window and yet city officials refused bidders the time needed to respond. That left us with just two unqualified bids.
 • The bid review and approval process must be written and published. It was not. The Bid Review Meeting minutes lacked the very little detail revealed at the review. And more.
 • We all know every municipality is allowed to publish the plans. We all know bids become public 30 days after unsealing. And yet the commission and city officials still denied us access to the plans and the bids you eventually provided are incomplete. What are you hiding?
We demand the commission delay action on these items for 60 days or more because ...
 • You denied citizens the documents needed to protest your action.
 • You are violating the requirement for competitive bidding.
 • The design violates the spirit of the Americans with Disabilities Act.
 • The design violates KCB ordinances.
 • Navigating the "upstairs/downstairs" layout is nearly impossible.
 • The parking and traffic pattern is abominable.
 • The planned post office space will lose even more boxes.
 • The overall design destroys the open and inviting city hall park we have now in favor of a tiny, cloistered sitting area watched over by city employees from their raised observation posts and tower.

Stop what you are doing and give your constituents a voice.
