What Comes Next?
We're [pretty sure] the city can't start demolition today. Based on other precedent, KCB has to evaluate the bids and present them to the commission. The Commission must then pass a resolution in a warned meeting to accept a bid. The City Commission Regular Meeting and Public Hearing is June 15, 2023. The agenda and meeting packet are still **TBA** but we expect the Commission to have a resolution at that Public Hearing. (The agenda and meeting packet for the July 20 City Commission Regular Meeting are also **TBA**. No special hearing is posted on the website yet.)
Once they pass a resolution to award the bid, the administrator sends a contract package to the bidder to be signed. Cities typically allow 10 days for that. The bidder signs the contract package and returns it to the city for sigs. Cities typically allow 10 days for that as well. At that point they start to set the construction schedule.
We should have until June 25 to request a referendum petition from city clerk Silvia Grantsee and July 5 as the date we may need a Stop Work Order (actually, a TRO or injunction). Those dates all hinge on when the city commission resolves to accept a bid and sets the demolition and construction schedule.
We are meeting with a law firm with extensive municipal and litigation experience. This will be a working session:
- Craft and format the request for a referendum petition to be presented to the city clerk.
- Work out how to get the petitions to KCB voters and returned to the city clerk.
- Be ready with an injunction or TRO to stop the city until people can vote.
