I'm calling I'm calling in because on August 3rd, the Recreation Committee members all received a copy of a letter from Vice Mayor Colonell requesting the city commissioners Re-evaluate the location of the basketball court. When the location was selected, by our committee on in April of 2025. It was thoroughly vetted by looking at options that bic Mayor Colonell has and we didn't select them because the Recreation Committee did not want to take down trees, we didn't want to use more green space. And then the other concern about the retention pond and safety, I'm sorry, was also looked at, and there are landscaping plans in place, and plantings that should mitigate any safety hazards with the basketball court being located where it's supposed to be. So after our very thorough discussion at our August 13th meeting. Again, the Recreation Committee wants to reaffirm that April 2025 decision. And please go ahead with where the basketball court is recommended to be located. And I believe the commissioners have also received two letters from members of the community who justified their positions on the basketball placement.

Tom: Yes, I looked through that, and it looks like a very well-written proposal, very professional. However, there are a number of items in the proposal itself which are going to be difficult for the city. For example, it proposes that everything in the proposal is confidential, and asks us to hold it in confidence, and we have broadcast it to the world. We need to go back and tell them that we don't do confidential information like that, and if they want something confidential, pull it out. Also, there are a number of terms and conditions in there that don't meet our requirements, which need to go back, I believe, to V&B to have them put their, E-Verify, and no debarment, and all those other certificates that need to be put in place before we can award a contract. So, I suggest that we someone take go through that contract and and get it to our standards so we can award it. It looks like it's a reasonably good contract. It has a lot of requirements for us, either the city or for U.S. Water, for example, we have to provide two people to do the work while they're on site, and I'm not sure whether that's going to be city employees or U.S. Water but, we need to make sure we're planning for that so that we don't hold them up, so they can't charge us extras. So, I just wanted to make sure that somebody goes through the contract and make sure we get the contract to our liking and that we're set up to execute it the way they've outlined it in their proposal.

Erin Deady: Good morning, my name is Erin Deady, I'm a planner and I'm an attorney out of Delray Beach, Florida. I do consulting work for the county and many of the municipalities down here, specifically with regard to resiliency, flooding, comprehensive plans, those types of issues. What I'm here to talk to you about this morning is a successful grant that we are winding down that the City of Key Colony Beach was awarded, as well as the other municipalities in unincorporated county, to create what's known as a Watershed Master Plan which is a plan that can assist you with your participation in the Community Rating System program, which is really important, because that program reduces flood insurance premiums for people that pay for flood insurance within the community.

 

So the team that completed the Watershed Master Plan, there maybe is a familiar face on that list of myself and Lori Lear, who is contracted with the City to be a consultant for your participation in FEMA's Community Rating System Program. The firm WSP assisted us with modeling, and the firm Clearview Geographic assisted us with the mapping and the geographic information systems output.

 

So just a little bit of a broad brush on what the community rating system is. Approximately 244 communities throughout Florida participate in the program, so it's a pretty popular program when you stack it up against the counties and the municipalities, and both inland and coastal communities participate in the program. The whole point of participating in the program is that the better you do participating in the program, you get discounts on your national flood insurance premiums in the community, so it's very important. The way the program is scored is that you have a class rating. Those ratings go from 10 to 1, with 1 being the best and the higher scores are, the worst participants in the program. Florida has had a pretty good history with participation within the community rating system program when you stack it up against states nationally, but what's been very difficult is for communities to break what we call the Class 5 or the Class 4 barrier. The reason that is difficult is because you have to have what's known as a watershed master plan. And it's kind of a different way of modeling the influence of the stormwater management system that also requires us to look at tidal flooding and future conditions. And most communities, when they do stormwater master plans, they are focused on the here and the now and the operations of their systems. So what the state of Florida did was they created a grant program with hazard mitigation grant funds, which are federal funds. They passed those funds through the state and provided communities with 75% matches for these grants to conduct these watershed master plans. The point was to help communities break that barrier so we could see more ranking 4, 3, 2, getting those increases in blood insurance premiums. So, communities are stopped at a Class 5 unless they have that watershed Master Plan. It is a prerequisite to get lower. So that's why you see this gap here between everything leading up to the Class 5, and then for the Class 4, Class 3, Class 2. Monroe County was one of the first communities back in 2019 to break that barrier. We worked for 3 years on that watershed master plan. We were one of the first in the country that undertook this kind of different way of modeling stormwater management systems. And so, what we wanted to do with this partnership is capitalize on that success, and not just have the county update its plan in 2024, 2025, but bring in the municipalities, because flood insurance premiums are so high within Monroe County, it makes sense for the county and the municipalities to participate together, go after these grant funds, conduct their watershed master plans, so we could lift the barrier on that prerequisite and pursue, an improvement in the class rating for all of the communities.

 

So, without a watershed master plan, a community is stagnant and can get beyond a 5 within the program and not receive more premium discounts, because every improvement in your class rating, you get 5% more reduction in the insurance premium, so that's really important. City of Key Colony Beach started participating long ago within FEMA's Community Rating System in 1992. As of 2023, you are at a Class 6 ranking with a 20% discount in flood insurance premiums. So if you are a resident, and you have an NFIP flood insurance policy, when you get your premium, there's literally a discount that is marked on your invoice that says CRS discount 20%. And so, if we got to a Class 5, that'd be 25%. A Class 4 would be a 30% discount on premiums, so that's a good thing.

 

So we secured, in 2022, a grant for $106,000 and $218.75 to create, that Watershed Master Plan. And for the 25% that the city would have been obligated to cover for that grant, we were able to use previous work that we had done on a vulnerability assessment, and the state was willing to count that as the city's 25% match. So, none of the local government jurisdictions within Monroe County had to come out of pocket cash to meet that 25% obligation. And if you work in grants, you know that that is a huge win, to not have to pay any money towards the creation of this plan.

 

Watershed master plans have to be updated every 5 years to remain in the CRS program and to continue to receive credit for that Watershed Master Plan. This is the first one that we've been able to conduct for the City, so the City would have to revisit this by 2031 to remain eligible to receive those points. It builds on data that we have created within the city's previous vulnerability assessment, work that we had done with FDOT throughout the county to map and locate stormwater structures along US-1, and we modeled the performance of your stormwater management system, operations, and under various flooding conditions. It primarily looks at the flooding operations of your system with regard to rainfall, but we also have to look at what the system does when we see increased tidal flooding over time. And we have to model that tidal flooding condition out to 2100. That's not a number we pick. FEMA says, if you want to conduct a watershed Master Plan, you've got to model the 2100 condition. So we met all of that criteria, and built our model, and we were off, off to the races.

 

So, the grant deliverables have, been completed. Criteria, there's a significant manual of criteria that we have to meet, for participation in the CRS program. That criteria was updated in 2021, but it was also updated in 2025 when we were in the midst of this project and what we were doing. Luckily, the flooding scenarios that we chose to model were more conservative than what the changes were that occurred in 2025, so we didn't have to recalibrate anything.

 

The other thing that we did, what the grant requires is that we transmit the Watershed Master Plan to the entity that reviews that plan and scores it for credit. We are not required to actually receive a score on it, but our team, were really aggressive with the communities that we work with in this program, so we wanted to make sure that we had a preliminary score to make sure that the work product that we were producing was actually going to yield the result we want in the CRS program. So, our initial scoring sheet was 120, we met the criteria, with the only thing that we hadn't met, were not able to meet, was that we have to adopt the plan. So, as soon as the city adopts the plan, we know that we have at least 120 points within the CRS program, but we believe that they actually made an error, and that the city is actually entitled to 145 points, within the program. So any more points that you're getting within CRS is a good thing, because that's making progress towards increasing your class rating. So when we transmit the plan to ISO, when you're in your CRS review period, we will work with Lori to fight for those additional, 40, 25 points. And those 25 points are because you have a stormwater utility stormwater assessment ordinance already adopted and on the books. They basically want to see if you've got a plan, you've got some recommended projects, but do you have a funding source for it? And most communities implement stormwater improvements through a utility or assessment program, and you have that on books, so we think that you are entitled to those additional points. An important thing about a watershed master plan also is that it makes recommendations. We don't just model things, we make recommendations on what to do about it. And so there were 3 key project concepts we have some conceptual descriptions of what those projects would be, and we have some conceptual cost estimates in the Watershed Master Plan as well. I know the question coming, I do not have those cost estimates with me to be able to tell you what those are, but the first one is elevating structures that were identified to have a lower first finished lower elevation. Five structures were identified identify Project 2, installing additional pump-assisted ejection wells within the existing stormwater system. And Project 3, elevating roadways that are projected to be inundated by 2040 sea level rise or beyond, on Sadowski.

 

And so, these are the three key visible projects that we have recommended. We also have some policy recommendations related to updating the stormwater level of service within the comprehensive plan to account for tidal flooding conditions, because what we know as increased tidal flooding occurs, it reduces your ability to discharge rainfall-driven stormwater downstream. And so we want to make sure that any additional improvements to the stormwater system account for that condition. Looking at your shoreline ordinance updates, and what can be done there, and other regulations and policies. I do want to note that a key component of the Watershed Master Plan, when you go in to update it in 2031, they're not going to say, hey, did you implement everything that you said you were going to implement in 2026? There's no requirement that these things get actually implemented for credit in the plan. These are recommendations that could be subject to further analysis through a stormwater master plan or another component. So we did receive one comment from Commissioner Harding, who pointed out the history of the stormwater system and the stormwater, assessment program within the city. We had only talked about your last rate adoption in 2024. He thought it would be prudent to go ahead and add more language about the city's history in terms of levying selecting in your stormwater program overall. We are happy to do that. We don't think the document is incorrect. The thought is that it would benefit from a more robust description of the stormwater history within the city. So, your options would be to adopt the plan today. You have a resolution in front of you. I don't know, I defer to the city attorney whether you can adopt and direct us to add a couple of sentences and, you know, make that industry more robust, or if you want to bring it back, that's fine, whatever you think. And so, at the discretion of the city, we can either make those modifications, or you can adopt today, or again, I defer to him on process.

 

So that is my presentation. I do want to note that one of the other beneficial things of a watershed master plan is that it sets you up to create a foundation to pursue further grants from the state of Florida. For instance, the Florida Department of Emergency Management has provided grants to local communities to do stormwater master plans, which would give you conceptual project design, cost estimates, and lay the foundation for permitting for projects, so that might be a grant that's available to the city. The state's Resilient Florida program also provides grants for capital projects. And we now have a recommendation, for instance, on the road elevation along Sadowski. We're a year out. Those grants are due September 1 each year. That is not something just heading off the question, that is not something that can be pulled together in two weeks for this granting cycle. Those grants are highly competitive, so you want to plan a year out, but this kind of lays the foundation. If you wanted to pursue one of those grants next year. That provides up to a 50% cost share in this community, potentially, for road elevation, which other municipalities have been successful within the resilience of Florida program with it throughout the Keys. So this, this helps check that, that box.

 

The last thing I'll mention, as John is very aware, as he has sat in on the project meetings, there is another grant that is being implemented right now with the county and the municipalities to update the county and the municipality's vulnerability assessment to new sea level rise projections, as well as develop project concepts in what's known as an adaptation plan.

 

The identification of projects is a pathway in a vulnerability assessment is a pathway to grant funding from the state in the Resilient Florida program. So now that we have the Watershed Master Plan done, we can take all those project recommendations, dump them into the vulnerability assessment, and check that box to make you more competitive for a potential grant application in that program next year. So I'll stop there, and I can take any questions.

 

Foster: So, I personally want to this is this is another great tool to put in our toolbox for saving the citizens money, and if you look at the master plans we have in the city, we have one for the stormwater, we have one a plan for our sewer plant. I call it a system health plan. Master plan works. But this will really help us in our pursuit to go and get reductions in costs. And we've already been very successful in getting grants for stormwater mitigation. I mean, we've got millions, in fact, we've got $2.3 million on the table right down the start for flood mitigations on West Ocean Drive. So we've been very successful. This can only increase our ability, and you brought up Sadowski Highway. We're already putting a grant in for the engineering and planning, and we will have it done in two weeks. Will we not, guys? So, so we're kind of, we're not waiting, we're moving ahead, but again, this will help us in our, in our pursuit to protect the city, and bring down the cost of what it what it costs to keep insurance in here. So I can't thank you enough. It's been a lot of work, and we've been doing this for what, about 3 years now?

 

Deady: Yes, yeah, this state had a tough time with this program because when they got the federal money, they only had a certain amount of time to utilize it. So they had a very short, what I would call, burn rate on this grant when they awarded it, and luckily they were able to move that out so we could all complete the projects and do them well. So, yeah. Yes, it has been a longer effort than anticipated, but you got a great product.

 

Foster: Again, our CSR rating? Once this goes through, let's see what we get out of this. I've been able to track that 5 level, and this blends in very well with our vulnerability assessments that we have. There's just so many things that we've done that, I guess maybe people don't see, because it's just work. It's just stuff we do behind, you know, behind the scenes. But the faster plan just adds to our toolbox of things that we can do for the city. I can't thank you enough.

And we had a meeting we had a couple of meetings, but then we had our final meeting between the groups, and what we did was we went ahead and, instead of population, which is what it used to be, where we would only receive about $150,000 a year, we went ahead and discussed in detail, and it took a while, but we discussed in detail the needs for each of the cities. And we were able to demonstrate the need for Key County Beach based on the, our flood mitigation. Our streets, our sewer plant, and other things that qualify in that stewardship language. And we were able to secure $1.5 million each year for the next 5 years provided it's funded, and it has been historically, and we've actually done very good historically in it. And I gotta thank the staff and Mittenhauer and everyone else in the Commission for doing this, because putting these grants together and putting this documents together to satisfy the DEP that you have a shovel-ready project that benefits the language in the proviso language is important. So, through that that meeting, and it was it was a long meeting, John was on it, it was, we we went in with a mission, and we came out very well. Harding: Sure, I'll talk about it. So the scope of this project is a engineering analysis, report. So it'd be a report specifically for Concallony Beach, West Ocean Drive to look at analysis of wave action and analysis of where placement of a Beach restoration project would go. And then once the engineering analysis is complete, then you could take that forward to the state, potentially for an appropriation, for actually construction implementation. So this is phase one of the project. And part of that beach restoration would include Sunset Park Beach. And one thing that, you know, when the mayor and myself went through this with the engineering firm is that, we don't have a really good documentation how much beach erosion there is. When I checked with some of our neighbors on West Ocean, it was kind of shocking to me, the beach erosion numbers we have. So one of the things it highlighted is we probably need more homework there. So, this is a great opportunity for us to get a grant op grant funding for the engineering, and then the match, is probably a placeholder at this point, and whether we can get private contributions from the private landowners along West Ocean could be very good, feasible to support that. And at the end of this, we would get a recommendation to take, hopefully, to a state appropriation. Our state representatives are very supportive of this. And have gotten recon have gotten appropriations for other neighboring areas within the teams.

 

 

Foster: So, a little history of this. We were in, in Representative Mooney's office, and he had this information on the board about Coco Plum and it and we we looked at it, and we're like, what is this? It said beach restorations. And this is a couple years back, and kind of With the conversation and talk about all the erosion on the beach, especially West Ocean, but East Ocean also has the same issue. We, we're able to to Get in touch with this company, get a presentation, and we we found it really really interesting, and enough time had passed that they've had proven success in many locations now. And currently, right now, Cocoa Plum, or Grassy Key. and Pigeon Key are slated to be deployed with these for protection of the shoreline. And it doesn't just protect the shoreline, it actually redevelops the beach. The design is such that the wave attenuation device, takes the energy from the wave and actually uses it underneath, and pulls the sand up and deposits on your beach, so you actually grow your beach. It's also been proven in Category 3 and 4 to lessen the damage to the island. It hasn't been through a Cat 5 yet, and knock on something, Wood, we never, we never see that, but it has demonstrated, a very substantial improvement to land restoration and loss of destruction from hurricanes. So this is really, really good stuff. And if you think about it, we also have nesting turtles on air that would, would benefit from that. And you have infrastructure impacts, I know I've seen it on East Ocean where the wave actually, when the tides are really high, will come over, and it comes all the way to the street. So that one impacts the undermine of the street itself, and if you have your sewer and water your sewer and stormwater catches there, you can you can impact your infrastructure with these types of activities from the ocean. So, I think I think we got a good story to tell, and we've I've also met with the Deputy Secretary of the DEP and explained with him what some of the issues are, and they're very keen on this. They like this. The company that, we're dealing with, there's a couple other companies, they have a proven track record. So I think this is really gonna be, something that we'll benefit on the land improvement, the beach improvement, and in addition to that, we can protect our infrastructure from the streets, the sewer, the storm, and if the science is like I believe it is, and I've read it, we have a Cat 2, Cat 3, Cat 4 storm. We may not have the boulders rolling through people's houses like we have, from Irma. So, I think it's really, really good stuff. I'd encourage you, the company's called Blue Terra. I'd encourage you to look at it. But the people that live along East and West Ocean, including all our infrastructure here, could really benefit from this. So, as Tom said, this is a placekeeper for us to move forward with, with the wave study and, if we can if we can demonstrate sufficient data and science and buy-in. Hopefully, we can get some private contributions. I've met with all the condo owners, at least most of them, and it's it's it's got traction, so I'm looking for approval on this, so we can go ahead and put this as a placekeeper, and we'll we'll move forward, because it only protects the city. At the end of the day, that's what it's going to do. So, enough about that. Pco 14, Revision 4 for the revised, ductwork at Marble Hall for $26,888.73 is to replace all that old fiberboard that was in the, Marble Hall that was musty and, biologically incorrect. So we're replacing it with, new metal duct, hard duct, with a, duct wrap which is what we should be doing, really. The time extension these change orders, we do have a time extension. I noticed in the parentheses here, it says time's not defined, but that's been part of this go back and forth with the contractor for the last two weeks over all these change orders. We did negotiate a 7-day add to that. The ductwork, you know, is, critical to doing the ceiling and some electrical work, and some, HVAC work, so we saw fit that, the architect and I went back and forth with them, quite a bit, but, so we, we felt that 7 days was fair. So I would recommend that we approve this, and let them replace that ductwork. The

Doug Colonell: The, the insulation, I don't know, how to really say this but the but the architects maybe missed it, and it they missed it because of maybe a change condition, or they didn't see it in their in their discovery, or their their pre-project planning. But, we're going to foam, spray foam the underside of the of the roof deck in the administrative area, in the new part of the building. And, then we're gonna put, bat insulation at the bottom of the trusses kind of creating a, a seal. So the foam would be on the underside of the roof deck, down the wall to the bottom quarter of the trusses. The trusses would then get furry strips and, bat insulation, R16 R21, I'm sorry, on the foam and the batts Jen, and we did give them a time extension of 5 days on that. They had asked for 10, and we negotiated for 5. So I would suggest we do that one as well.

 

The PCO21 replaced the existing air handling units. We replaced one because we thought that there was one unit that was bad, but in fact, both units are about the same age, and they're both they're both on their dying leg. So, this is the time to replace those, and so we had one unit already approved, and it's already set, and we want to approve the second unit. And part of that change order is the line sets, between the condenser and the air handler they're criss-crossed. So, the one on the west runs to the condenser on the east, and the one on the east runs to the condenser on the west, which is ridiculous, and inefficient. The other thing that we wanted to do was get a programmable T-Stat so that thermostats so that we can control the units in a more efficient manner, instead of both units running at the same time all the time, that, you know, one unit would be the slave to the system. You know, you would run one unit, and if it called for more cooling or heat, then, you know, we would kick in the other unit. So, it's a more efficient system, and, you know, we're building a brand new building. It's kind of like getting a new car with new upholstery and new tires and leaving the old engine in. So, I would suggest that we do that as well. And and that one is we also have a time we define the time on that one, too. Let me just find it, I've got so many of these things. That was also a 7-day, so in total, you got 14 days on the mechanical, issues.

 

The next item Let me just get back to where it was here, Okay, PCO22 is for the, the pergola on the, on the main patio. The slab we changed the slab, if you remember, we originally had a 6-inch slab, and we changed the slab to a 4-inch slab, and we we were going to build the slab ourselves, and then it ran we ran out of contract time on the alternate with the contractor, and they came back and said, well heck, we'll do it for the same price, but instead of a 6-inch slab, we'll give you a 4-inch slab. Well, one of the things that has been complicated with this is that the 4-inch slab is not adequate for the pergola. So what we did is we persuaded, Pedro Falcon and Bella to build us a 7-inch, perimeter, which will be sufficient for the pergola. So, this is the pergola, and it's through a premium pergola. It's, it's a very nice pergola, I was thinking white, and I think the architect was thinking white, but they make them in other colors, and they make them in bronze, and so I've asked for some information from the manufacturer, and the other nice thing is that we are doing this outside of the architect's contract. He has nothing to do with this. So we won't pay a premium to him, and the contractor has agreed, to do this at a 5% fee, but it falls under his umbrella, which is a very clean way of doing this, instead of introducing a new contractor, and, you know, we go back to the finger-pointing, and so it makes a lot of sense, so I would suggest that we go forward with that one. As far as a schedule goes, we can't tie Pedro Falcon the contractor into any timeframe on this. It's a 14 to 16 week lead item, so, it's not fair to tie that into a and we and we don't want to give them a 14 weeks, extension for this, so the time would be outside of our contract with them. So I think it's a good deal, and I would urge the board to, to approve it. So, there we are. Any questions?

We're in the 10th month, 10th month of the 2026 fiscal year, which you can see in the general fund is we've got now a negative balance, so we're at that time of year that, the positive balance, the running balance, goes down to a negative value what are typical revenue coming in now is business tax licenses, so Tony's a very important person right now, bringing that in. So you'll see that fluctuate between zero and negative for the rest of the year. Total revenue is in good shape. We're very close to what we estimated in the budget. Total expenses, were actually very close to budgeted value, so some of the last-minute requests going in have, helped to get us back to the budget value. Building fund still is in good shape, with a positive value of $64,000. The city, we all realize this, but City Hall Harding brand has been fully utilized, and the full reimbursement has been received. Thank you. Pickleball shade payment was paid and reimbursement requested from TDC. Infrastructure, we did have, reimbursement to the Seattle grant in July, and then, it'll show up in the August financials of almost a million dollars, so that, has been received, but it'll be in next month's financials. No pay requests received for July for the City Hall project. And then, payments have started for, the City Hall loan, and then we still have the, infrastructure loan for Sadowski, so both of those payments have been made. And Wastewater is the next page. Again, we're in the 10th month. Income is very close to what we expected in the budget. Expenses are over budget, and we'll end up the year being over budget, really driven by sledge hauling and plant maintenance. I do expect the end of the year will be negative. Again, this is really driven by the increased expense of sledge hauling, which Was increased for, budgetary planning for next year.

 

I do want to make a recommendation, either we do a motion or get a head nod, but looking at the expenses for sledge hauling, I think we're at a point we should ask for a formal proposal from Jason at mid-hour, or, I'm sorry, CPH to, do a business case analysis of options for, processing in-house for sledge hauling that could be many options could be centrifuge, could be screw press, drying beds, more usage of drying beds. So I'm basically looking for an engineering analysis of is that a good, feasible business case with some business estimates for the construction? Not to actually go for a loan or anything, or a grant or anything at this point. Typically, Jason's prices for those are about $15,000 to do, an engineering analysis, so I'd like to get feedback, if everybody would like to go forward with that.

Just one matter, this relates to the issues that were discovered this year with the PIN files and the slab at City Hall, under a previous contract by the King's Enterprises which discovery necessitated 3 change orders to the current project. That is, change orders to demolition, a change order for CBGH for design, and a change order, for Pedro Falcon for rework. Since we're in public setting, I would like to say that, you know, I would encourage us not to have discussions about the facts or the merits of the case or numbers per se. We have, however, done our calculations and our analysis, and so we would like a consensus, if you will, to open negotiations, to authorize us to open negotiations with the Kings Enterprises to cover all economic damages and attorney's fees that we have identified. We we have identified economic damages in the amount of $300,000. The attorney's fees would be the past, present, and future. That would be a number that, you know, will change and will refine, but the demand would be, you know, the demand for negotiation would be $300,000 plus those attorney's fees. We're not asking at this point for any permission to file a lawsuit. Any responses that come back from TKE, we can bring to you. So, we're looking for, again, your consensus, and if you prefer a motion, we can have a vote, but I'm fine with a consensus that there's no objection to authorize us to set the seat.

 

 

Foster: So, I'll I'll mimic what Doug's gonna say. Is it worth the squeeze? In other words, are we gonna spend $200,000 to get the $100,000 back?

And then, the last thing I've got, on the wastewater painting project, I did get the paint specification from Sherman Williams. It's about a 16-17 page document of how to prep, how to prime, how to all do all the painting, specifications for all those. So that's with the staff now. Just as a reminder, we need to get that out for a request for quote for 18 contractors you know, for the plan. And then one thing I did clarify, I finally I spent about a couple hours with the insurance person over there at the plant We have 2 steel tanks and 2 cement tanks, the four tanks, so, just let everybody know. Bajai, and then, we the tentative, happy hour would be possibly a key Colony inn for 3 to 6. And then they can stroll over to Marble Hall, and there'll be a Texas holding tournament. So, that's Thursday. Friday, we're looking at a Snapper Derby held at the Keytown Arena, and I believe one of the committee members will be reaching out to Jim about the awards ceremony at the Naughty Turtle. Saturday will be Hot Dogs in the Park. Will the police department, along with band and Beer just like our welcome back party was this spring. And Sunday will be pretty much, taken care of by the 90 volunteers that Ted and the Community Association have, but we are adding a commissioner's Breakfast which we're limiting to 250 people. And, of course, the parade will be starting at 11:30 that Sunday morning. So, that's all I have right now for an update. There'll be more to come in from September's meeting, and like I said, probably October, November, we'll have a calendar that will be displayed along with my updates, so everybody can see how this is coming into play.

Number one, I would like to acknowledge and thank Tom Harding, who has spent a lot of extra hours on this sewer plant, and I think he's been instrumental, from what I've watched, in helping shape good decisions with the utility board. And I'm very happy and excited that we are making some really good, improvements to that sewer plant. So, I wanted to make sure that, Tom, you knew that, you know, it doesn't go unnoticed.

 

The, and then the other. I'd like to acknowledge the mayor here. I think Freddie has done a fabulous job on, his leadership with these grants. And that he's been able to, secure these grants. He was savvy enough to not grab the first offer on some of these things, and, I think he's represented the city very well. And, he's growing our city through grants, which is really the only way we can do this, and maintaining our city through grants. So I I wanted a shout out to you two guys for some tremendous work, and I know it's been a lot of work.

 

And then, I guess I I guess I owe an apology. I do owe an apology to the Recreation Committee, because I probably led them astray and distracted them from really what I felt was a core issue on the basketball court. That the pond is constructed not like the old pond. The pond is 8 feet deep in the middle. It appears to be very shallow. And it I just woke up in the middle of the night one night thinking, I got grandchildren that are 5, 6, 7, 8, 9 years old that would be playing on a court like that. And they'd go in that pond in a heartbeat to get their basketball, or their volleyball, or their pickleball, or whatever it was. And so that's that's why my reasoning for revisiting it, and I think maybe conditions change, because you know, there was a 4-foot high picket fence to be constructed around the pond, and that was eliminated. I understand, and I and I and I get it. I just also, when the city commission approved the location of the basketball court, they approved it, predicated on the that the basketball surface would be painted green, which would fade into the landscape, and that there would be no fence. So I just wanted to make sure that we pinch ourselves and we realize that whether we do it with trees, and I think Dave Evangelista was instrumental in bringing this up to the committee. So, whether we do it with landscaping or vegetation or whatever, That's that's in the immortal words of Tom, Forrest Gump, that's all I got to say about that.

 

Moving on to the, to the City Hall progress and update for everybody. We've roughed in a lot of the plumbing. Electrical is a little bit slower because we don't have a watertight condition. Everybody realizes that the roof trusses have become an issue. They were supposed to be on site a month ago, or even sooner. And, I think the contractors had a very difficult time. But I've been keeping close tabs with him, and, you know, I expect those trusses in the next few days, and hope and pray. So they are holding up the watertight condition, which would allow other construction to go forward. So I just want everybody to understand that.

 

We've completed all the structural tie beams, and a lot of the concrete work on the project is pretty much completed. We've gotten a lot of the housekeeping pads in, the mechanical pads are in, the generator pad was poured yesterday, so we've pretty much exhausted a lot of the concrete work. The, the windows are in on the second floor, including the glass. Stucco is underway. They've, started the exterior stucco. The elevator is, sort of on hold until we get roof trusses and we get a weather-tight condition, I believe, and we get permanent power. So there's a real critical pause here that trusses are causing. The water service is completed to the inside of the building, we've gotten that done. We've done a lot of electrical work inside Marble Hall, where we've eliminated fire hazards from old, abandoned wiring, and we've cleaned up a lot of the spaghetti in there, and we've run new power feeds for our new air handling units. And, so we've gotten all that done. I'm told that, interior framing will begin in the administrative area, beginning on Monday. They're moving gonna try to get some of that done, so we're moving some work in and out of sequence to try to keep progressing.

 

So, the project as of today, is day 254 of 322. Now he we just approved a couple of change orders today that would extend the schedule by, I think, another 19 days? So the contractor has somewhere around 80 days left.

 

There is one pending change order that's been going back and forth, and back and forth, and back and forth. It's called Revision 5, it's PCO I forget, I don't have it listed here. But it's some plan revisions, and it involves the raised sidewalk at the electrical service, and planters that were eliminated, and railings that were are to be installed, so it's been going through a lot of scrutiny between myself and the architect, and we're working on that change order. So, that's kind of where we are with the with the building construction. If anybody has any questions, I'd be happy to take your $2 and answer it. I got one request for you. I've just talked to Rick and Dana Lieder. I've had a couple conversations with them recently, and they had requested that we could have two dedicated 20-amp receptacles at the vanstand, i.e, where the platform is. They think that would be very appre Very, very, well received by them.

I've been working with him quite a bit, and going back and forth with him, and we've got a pretty good design, and he came up with a design that I've passed to Kyle Bechtenheimer at CPH, where they've agreed to do our structural engineering for, the foundation of this thing. Don't want it falling over on anybody. So, that's moving along pretty good, and the diamond's in fabrication. You know, I, Sandy Bachman had brought it up under her commission, or her committee, and, she has proposed, or kind of liked the idea of a fountain, which was not on was not part of the plan in the beginning, but maybe should be up for consideration. So I'll leave that to Sandy to lead the way on that. But we're getting some donations. We got a couple of nice donations, especially one from Sandy's, group. They they donated a lot of money to it, so, you know, I appreciate that, and we're we're gaining on it, so it's get we're getting there. Alright, so, grant update, I believe, most people have seen the letter we sent out, and it's a grant update, it's not a project update, so it does show what grants we've got and what the matches were that went with it. Proud to say that this commission has, it's been very successful, and it's a lot of work for a lot of people, including the staff. And we ended up getting a little bit over $16 million, and while we've been, busy here. So, it's, it's, it's probably, probably not too bad. I'd say we, we've earned our keep. The, we also have, several million dollars out there for additional grants we're looking for, and if, our track record is anything, I think we should be fairly successful in, quite a few of those, with more to come. Always looking for, especially if it's, no-match grants, they're the best kind. So, we're, trying to do the beautification of the city and protect the city with the, especially, I think, I think Doug, or I think Doug might have said it, that the sleeping giant, the sewer plant out there, that's, people don't see that because it's behind the bushes, let me tell you. We need to put some, we need to put some time and money in that place, so we're we got, we got some work to do on that. The last thing is your mayor has been elected to the Florida League of Mayors, I believe that there may be a bulletin blast out there, but it's, kind of an exclusive club, so, I was, the mayor of Islamorada was there when that when the voting took place, and I was inducted in it, so more to come on that. I hope to get some more information from the, other mayors, and also we would we steer some of the, the items that are before the the city, or the state as a whole, and, more to come from that. So, been we've been busy.

As far as that extension, for that permit. Originally we were told by Tony that we didn't qualify for any tolling. Upon further research, we believe we do qualify For multiple tolling, of that permit. I don't know if you guys we're given Our emails back and forth. There are certain, executive orders that were issued by Ron DeSantis. Over the last couple of years, 26-144, 25-215, 25-214. I added some of those to the emails. So I wanted to put that on record. Also, we had an issue with the city about this outflow pipe that runs through our property. From the overflow lot, That we were never aware of. It's not on our title, it's not on our surveys, it's on nothing even the even the electric company in the Keys, in Key Colony, does not have any idea of that outflow pipe ever being there, and their pole is right next to your we thought he'd do it outflow pipe.

 

So back in last year, November, I asked. And I sent Silvia an email for a public record request regarding information on this outflow pipe. To this day, the only information I have is Tony couldn't find anything, on it. Because I asked for records requests, I asked for records on this pipe, the maintenance of this pipe. When was this pipe discovered? So on and so forth. We never received anything. So, this is an expensive project, on this property. And now we find out we have a pipe that runs on our property which changes things. By never receiving any information from the city our project was on hold for quite a while. So please take that into consideration as well. When you're when you're moving forward with these projects, and you come across these things. Now, I've had conversations with With some people in the city, about it. But again, there we believe we're entitled to tolling from when our permit was originally issued, till now.

 

A little further back, in 24, we filed a set of plans, and approved the set of plans. And then to come to find out that the city had changed the ordinance, the 2-foot ordinance on flood, so we had to go back to the drawing board as well on that and redo another set of plans, which now I find out that the two-foot ordinance the two-foot ordinance is going away as well. So that was another waste of money on this project. So please keep that in mind.

 

I'd like to put it on the record that we are entitled to tolling on this permit. I've been told this by multiple legal people, I've been told this Oh by different people. Please look into it before we make a final decision on charging me for a permit extension.
